Implications and challenges in the defense of rights

It is necessary and essential to move forward in adapting legislation to the guidelines of the New York Convention and to guarantee the rights of people with mental health problems so that they can exercise their full citizenship with equal opportunities.

However, the existence of mental health legislation does not in itself guarantee respect for and protection of human rights. Understanding and defending the rights of people with mental health problems is a responsibility for all citizens, and especially for the legal system and services that provide care to people with mental health conditions.

The recent civil and procedural legislative changes to support people with disabilities aim to modify the approach to their right to make decisions. This new approach is intended to be more accurate and address situations that, until now, have been overlooked or ignored, such as the fact that people with disabilities have the right to make their own decisions.

There is no doubt that people with mental health problems or intellectual disabilities are still subjected to severe discrimination worldwide, varying according to each country's level of democratic development. Despite progress made in many countries, prejudice, violence, social exclusion and segregation, abuses in treatment, and attacks on their capacity to make decisions are still far too common.
